1. Agreement to Terms

By accessing or using apexcarbonfiberseats.com or purchasing any product from ApexCarbon (Apex Carbon Fiber Seats, Houston, TX), you agree to be bound by these Terms of Service. If you do not agree, do not use our website or services.

2. Product Descriptions & Condition

All products sold by ApexCarbon are genuine BMW OEM parts removed from production vehicles. Products are described as accurately as possible using real photographs taken in our Houston, TX facility. All known defects, wear, and damage are disclosed in the product listing.

ApexCarbon does not sell new parts unless explicitly stated. All parts are pre-owned unless a listing specifies "New in Box" or "NOS." Color, finish, and surface condition descriptions in listings are based on visual inspection under shop lighting.

3. Fitment Responsibility

Fitment compatibility information provided in each listing is based on BMW factory documentation and our team's knowledge. It is the buyer's responsibility to verify compatibility with their specific vehicle before purchasing.

ApexCarbon is not liable for purchasing errors resulting from incorrect vehicle information provided by the buyer. If you are unsure of compatibility, contact us before purchasing.

4. Payment

All payments are processed securely via Stripe. Prices are displayed in USD. Full payment is required at the time of purchase. ApexCarbon reserves the right to cancel orders and issue refunds at our discretion if a product is found to be mislisted or unavailable after purchase.

5. Shipping & Risk of Loss

Risk of loss and title for purchased products pass to you upon delivery to the carrier. ApexCarbon is not responsible for carrier delays, lost packages, or damage incurred after handoff to the carrier. All shipments are photographed and packaged per the specifications in our Shipping Policy.

6. Returns & Warranty

Returns are governed by our Return Policy. Warranty coverage is governed by our Warranty Policy. These policies are incorporated into these Terms by reference.

7. Installation Disclaimer

BMW OEM seats and related components interface with Supplemental Restraint Systems (airbags). Improper installation can cause airbag non-deployment in a collision or accidental airbag deployment. ApexCarbon strongly recommends professional installation and post-installation SRS inspection for all seat-related products.

ApexCarbon is not liable for injury, damage, or loss resulting from improper installation of purchased products.

8. Intellectual Property

All website content, photographs, text, and design elements are the property of ApexCarbon and may not be reproduced without written permission. BMW model names and chassis codes are used solely for fitment reference. ApexCarbon is not affiliated with BMW AG or BMW of North America, LLC.

9. Limitation of Liability

To the maximum extent permitted by law, ApexCarbon's total liability for any claim arising from a product purchase shall not exceed the purchase price paid for the specific product in question. ApexCarbon is not liable for indirect, incidental, consequential, or punitive damages.

10. Governing Law & Disputes

These Terms are governed by the laws of the State of Texas. Any disputes shall be resolved in the courts of Harris County, Texas, or through binding arbitration under the rules of the American Arbitration Association at ApexCarbon's election.
